Separation Agreement

For married or unmarried couples, a Separation Agreement can be used to legally formalise the agreement that you and your former spouse/partner have reached on separation as to property, children or financial issues. This helps to provide certainty and avoid the expense of a dispute arising out of any misunderstanding.

If your marriage has broken down but neither spouse wishes to issue divorce proceedings for some time, then a Separation Agreement can be used to address the more pressing issues relating to the finances, property and children, without the need to press ahead with a divorce.

It is important to be aware that the agreement is not strictly binding on the Court in the event of any subsequent dispute. However, the Courts will often stick to the agreement, provided it has been properly and fairly prepared and both parties have had legal advice.

We can advise you of the issues that you and your partner / spouse might wish to consider and, once you have agreed these between you, draft the agreement for your signature.
